Terms of Service

These Terms of Service ("Terms") govern your use of the abookify software, mobile and desktop applications, and the abookify.com website (collectively, the "Service") provided by PJ3 Labs Inc. ("we", "us", "our"). By installing or using the Service you agree to these Terms.

1. Licence

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable licence to use the Service for your own personal, non-commercial purposes. The server portion of abookify may be made available under a separate open-source licence; in that case the open-source licence governs the server software and these Terms govern the mobile and desktop applications and any hosted services we operate.

2. Your content

abookify is designed for you to use with audiobooks, ebooks, and other materials that you have lawfully acquired and have the right to use. You are solely responsible for the legality of the content you import into, generate with, or process through the Service.

You retain all rights in your content. We do not claim ownership of anything in your library. Because the Service is self-hosted, we generally do not have access to your content.

The Service can integrate with third-party services that you choose to enable (e.g., LLM providers, relay tunnels, online catalogues). Your use of those services is governed by their own terms and policies. We are not responsible for the availability, content, or practices of third-party services.

5. DMCA and copyright

We respect the intellectual property rights of others. If you believe that content processed by or accessible through services we host (such as the abookify website or any relay infrastructure we operate) infringes your copyright, please send a notice to [email protected] with the information required by 17 U.S.C. § 512(c)(3) (or the analogous provisions of the law that governs you).

We have no ability to remove content from servers operated by users of the self-hosted Service, as those servers are under their operators' control.

6. Subscriptions and payments

Some features may require a paid subscription. Pricing and terms for any paid offering will be presented at the point of purchase. If you purchase through the Apple App Store or Google Play, payment is processed by Apple or Google under their respective terms.

Subscriptions renew automatically unless cancelled before the end of the current billing period. You can cancel through your platform account at any time.

7. Disclaimer of warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

8. Limitation of liability

To the maximum extent permitted by law, in no event will PJ3 Labs Inc., its directors, officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service. Our total liability for any claim arising out of or relating to these Terms or the Service is limited to the amount you paid us in the twelve (12) months preceding the claim, or fifty Canadian dollars (CAD $50), whichever is greater.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access to any hosted portion of the Service if you materially breach these Terms. Provisions that by their nature should survive termination will survive (including ownership, warranty disclaimers, indemnification, and limitations of liability).

10. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. The courts of Ontario have exclusive jurisdiction over any dispute arising out of these Terms, except that either party may seek injunctive relief in any court of competent jurisdiction.

11. Changes

We may update these Terms from time to time. If a change is material, we will provide notice through the Service or the abookify website. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
